Do I need an attorney to review my Purchase Agreement for my new home if I already have a realtor?

By: Courtney Einterz

The short answer is – yes, it is always important to have an attorney review any purchase agreement you are entering into to ensure that your legal rights are protected, even if you already have a realtor involved. While your realtor will likely know the specifics of the deal, they will most likely not have the training to adequately explain or implement the legal provisions throughout the agreement. Realtors are incredibly knowledgeable and well versed in the world of real estate, but they are not legally allowed to give legal advice. It is your realtor’s job to organize the deal but it is a lawyer’s job to anticipate problems before they happen and ensure the Agreement protects the party they represent.

Having an attorney review your Purchase Agreement provides you with an additional advocate and ensures you are aware of all contingency clauses or deadlines that must be met to avoid a potential conflict with the other party.  Purchasing a new home is a very important investment and you want to make sure that you are protected on all sides. Due to the vast number of deals they are involved in, realtors often use standard forms that frequently don’t address a number of specific legal issues. Having an attorney review your Agreement can make sure all the important legal issues are addressed before you enter into it, which will save both you and your realtor from countless headaches. An attorney can make sure that the Agreement accurately represents all of your desires, while simultaneously protecting your interests. It is much easier to fix unwanted or hidden clauses or clarify cloudy details before closing than afterwards.
